Private investigator confidentiality covers any information and documents obtained and/or compiled by the detective and any assistants who have signed employment contracts with the detective in the course of the provision of investigative services, with the exception of information disclosed by the same individual to whom the private investigative services were provided, or information disclosed with their consent.

The detective and their assistants must maintain private investigator confidentiality.

The detective is not entitled to transfer information and documents subject to private investigator confidentiality to third parties, or to disclose this information or the contents of documents, without the prior consent of the individual to whom the services have been provided, with the exception of any information transferred to law enforcement bodies if indications are uncovered that a crime has been committed.

When information and documents subject to private investigator confidentiality are transferred, the individuals obtaining access to the information and documents subject to private investigator confidentiality must ensure that they are kept confidential indefinitely.

If a detective or authorized law enforcement body discloses information subject to private investigator confidentiality, both the detective and the individual to whom the services were provided under a private investigation agreement are entitled to claim compensation from the guilty party for damages sustained in accordance with the procedure specified by Russian legislation.
